[Tanzania] State files objection against 6bn/- suit by fishing vessel owner
After arrival in Dar es Salaam, the Director of Public Prosecutions instituted several court cases against 37 persons. On March 20, 2009, they appointed Captain Bendera from the said law chambers to represent the accused persons in the matter.
Other accused persons were acquitted. Hsu Chin Tai and Zhao Hanquing were charged with unlawful carrying out of fishing activities in the EEZ in addition to causing water pollution and degradation of marine environment.
Hanquing was charged with an alternative count of accessories after the fact. After full trial, on February 23, last year, the High Court convicted the two of unlawful carrying out fishing activities in EEZ and sentenced to pay a fine of 1bn/- each or go in jail for ten years in default of paying the fine.
Tai was convicted of another separate offence of water pollution and degradation of marine environment. He was sentenced to pay a fine of 20bn/- or imprisoned for 10 years upon failure to pay the fine in question. Both appellants defaulted paying the fine.
Having been aggrieved by the judgment, the two took the matter to the Court of Appeal. In its decision, the Court of Appeal reversed the High Court verdict and discharged the two Chinese.
Immediately thereafter, the two were rearrested and charged with same charges at Kisutu Resident Magistrate’s Court. But on August 14, last year, the Director of Public Prosecutions withdrew the charges by entering a nolle prosequi certificate, showing he was no longer interested to pursue the case.

UDOM council needs to promote government vision
NEWLY appointed members council of the University Dodoma have been urged to be key pioneers to promote government’s vision by adhering on core objectives and assist government initiatives of becoming a middle income economy.
The urge was given here yesterday by the newly appointed Chairperson for council of the University of Dodoma Ms Gaudencia Kabaka when opening the first duty meeting of the fourth phase council of the University of Dodoma.
Ms Kabaka noted that members should stick to core objectives by properly understanding their obligations and limitation, which governs the university and be key link between workers and management.
Moreover, the university council as the highest management body of the university should be ready to show the right way to solve all challenges that will arise in between and allow the conducive environment of the university to remain the centre of excellence, added Ms Kabaka.
Ms Kabaka added that the University of Dodoma was the unique one in the country as the fundamental plan of the government was to establish the university to accommodate all students who graduated from secondary schools through “MEM and MEMKWA” bases from ward secondary school.
She urged the council to assist the government to attain to that goal. Ms Kabaka said the capacity of the University of Dodoma (UDOM) to enroll students per year was 45,000. She further said that the intake could not be handled by any other university in the country.
The government, she said, directly depended on the quality of graduates from UDOM to enhance building the economy. The new council, whose members are normally appointed by the Chancellor of the University H.E.
Retired President Benjamen William Mkapa, comes from the ministry of education, health and Finance from Tanzania mainland and also one member from the Isles ministry of Education, Zanzibar.
In addition the council has two representatives from University of Dodoma Students Organisation (UDOSO) and two from Workers Council (THTU). The chairperson for the council is a presidential appointee post and the current fourth council chairperson Ms Gaudencia Kabaka was appointed by H.E. President Dr John Pombe Magufuli almost three months ago to man UDOM Council.
There are other three chairpersons including Dr Bilali, Ambassador Mwapachu and Ambassador Augustino Mahiga who is now minister for foreign affairs and East African Cooperation.
Meanwhile, UDOM Vice Chancellor Prof Idrisa Kikula advised all members to engage in high grade communication by enhance sides, workers council and the management to work together and observe the university’s regulation.
Prof Kikula thanked the President Dr John Pombe Magufuli and UDOM Chancellor Hon Retired President Benjamin William Mkapa for proper selection of the Council’s members whom he said, will help UDOM to go more forward in its mission
Central African Republic: Clashes leave 25 dead - UN

he had principally agreed with his visitor to launch the direct flights
between the two cities.He said the flights will help boost tourist arrivals, with Moroccan figures indicating that last year, the North African country registering 10.5 million tourist arrivals amid the target of 14 million tourists this year.
“There will be direct flights to Rabat...we will enhance cooperation with Royal Air Maroc,” President Magufuli said at State House, noting that the two countries had agreed to strengthen security cooperation, with Tanzania expected to deploy some 150 uniformed personnel anytime next year for an exchange programme.
President John Magufuli told his audience, including Vice President Samia Hassan Suluhu, Prime Minister Kassim Majaliwa, cabinet ministers, members of diplomatic mission and business community that the king had agreed to finance construction of the state of the art mosque in Dar es Salaam.
“We are here to build a modern economy,” Magufuli said, insisting that the friendliness between Morocco and Tanzania is deep rooted. At the ceremony, Prof Makame Mbarawa, on behalf of the government, signed an agreement with Moroccan Foreign Affairs Minister Salahddine Mezouar on air cooperation.
The agreement was just after Tanzania Foreign Affairs and International Cooperation Minister Dr Augustine Mahiga had inked another deal with Mr Mezouar on economy, science, technology and culture.

Central African Republic: Four dead in UN Bangui shooting
Four people have been killed during protests against the UN peacekeeping mission in Central African Republic.
The UN denies using live bullets and says its soldiers only used tear gas.
A group of Central Africans wants the UN mission to withdraw, saying it is failing to protect people.
The peacekeepers were deployed after civil war broke out in 2013 when then-President Francois Bozize was ousted by mainly Muslim Seleka rebels.
But the UN has been hit by several allegations that its troops have been sexually abusing children.

A coalition of civil society organisations called on residents of the capital, Bangui, to stay at home in protest at the UN mission in CAR, known by its French acronym, Minusca.
The coalition says Minusca is supposed to protect civilians and tackle armed groups in the city.
"But wherever the UN forces go there is violence," protest organiser Gervais Lakosso told AFP news agency.
As well as the four civilians killed, 14 people were injured in the clashes on Monday, with five peacekeepers among those hurt, according to a Minusca statement.
The BBC's Max Allaroum in Bangui says the deadly shooting took place at the main square in Bangui, not far from the UN headquarters.
The UN soldiers tried first to disperse the protesters by shooting in the air. They then shot at the crowd when it became more agitated and advanced on the building.
Minusca spokesman Vladimir Monteiro told our reporter the UN had only fired of tear gas to disperse the demonstration.
Numerous armed group still operate across the country - both Seleka and Christian self-defence forces set up to tackle them, known as anti-Balaka.

Bunge team declines debate on toxics
The report was scheduled to be presented before the committee members by the Vice-President’s Office (Environment and Union).
The MPs who described the report as hypothetical argued that they had never visited any mine site since the committee was formed, thus they are unfamiliar with the environmental issues contained in the report.
Konde MP Khatib Said Haji (CUF) said that the committee members were supposed to visit some of the mine sites and areas affected by the demolition exercise before debating the report.
He charged that some of the government officials have been providing their supervisors with false reports, adding that it will be difficult for the lawmakers to validate the report because they were not aware of the situation on the ground.
“One of the roles of the National Assembly is to supervise and advise the government. Therefore, they cannot debate the report of which they are not familiar with the issues presented,” Mr Haji said.
CHADEMA Special Seats MP, Hawa Mwaifuga, said that the committee had requested to visit some of the mine sites several times so that they can be familiar with some issues, but their request had never been successful.
She said that the committee deserves the rights to know all the actions being taken by government executives on some issues related to environment so that it can do its job well.
Singida Urban Lawmaker (CCM) Mussa Sima said the report was hypothetical because the MPs, as people’s representatives, were supposed to be involved in some incidents related to environment instead of reading them in the report. “We cannot allow this report to be presented in the National Assembly because we cannot prove the authenticity of the document,” Mr Sima said.
Special Seats (CCM) MP Faida Bakari maintained that the committee members will never debate the report unless their request is fulfilled. “We cannot validate the report because most of the committee members are new and we have not visited any of these areas as shown in the report,” she said.
Ms Tauhida Nyimbo (Special Seats- CCM) said environment is very sensitive issue thus legislators should make sure that they safeguard the interests of their electorate.
“We are here to work for the interests of our people and not the ministry. We are not ready to debate this report before visiting some of these areas to get the real picture,” he stressed.
On the demolition exercise, Ms Nyimbo said that there were some people whose houses were demolished although they were issued with permits by some government executive.
“How are we going to prove this if we don’t visit the sites?” she asked. Responding, the Deputy Minister in the Vice-President’s Office (Environment and Union), Mr Luhaga Mpina, said that it was not the responsibility of his office to coordinate the committee’s tours.
He pointed out that the committee was responsible with identifying the areas it wants to visit and inform the office of the National Assembly Clerk for further communications with his ministry.
Mr Mpina said that his ministry is ready to take the committee members to all areas which they will be interested to visit them.

US election: Obama calls Trump's election rhetoric 'dangerous'
Mr Trump refused in a televised debate to say he would accept the outcome of the election on 8 November.
He later said he would accept a "clear" result but left a challenge open.
Speaking in Ohio on Thursday, Mr Trump said, with a grin: "I would like to promise and pledge to all of my voters and supporters and to all of the people of the United States, that I will totally accept the results of this great and historic presidential election - if I win."
In the same speech, he said he would accept a clear election result but reserved the right to file a legal challenge in the case of a questionable one.

Republican Senator John McCain, who lost to Mr Obama eight years ago, said: "A concession isn't just an exercise in graciousness. It is an act of respect for the will of the American people, a respect that is every American leader's first responsibility."
First Lady Michelle Obama also joined the attack on Thursday, saying "you do not keep American democracy in suspense".

Hillary Clinton walked on to her campaign plane to the cheering and clapping of her aides.She told reporters she was relieved and grateful and joked there would be "no more naps"- a reference to Trump's repeated description of her prep days off the campaign trail as naps.
Mrs Clinton's stand-in for Mr Trump during the mock debates was one of her close aides, Philippe Reines, who took the role so seriously that he wore Trump cufflinks, shoe lifts and the same red tie as Mr Trump. After the debate, Mrs Clinton and Mr Reines embraced and he called her a "badass hombre".
Clinton aides said she would continue to highlight Mr Trump's refusal to pledge he would accept the results of the election. But would it be a real crisis on election day? Not if the result was a decisive win, they seemed to quietly indicate.
If Mrs Clinton and her team felt that she had closed the deal on stage, they kept their confidence in check. But the mood on the plane was certainly relaxed.

Mr Trump's comments come after a 10th woman came forward to accuse him of sexual assault on Thursday at a news conference.
Karena Virginia said Mr Trump allegedly touched her breast at the US Open in 1998 and made offensive comments about her to a group of men.
The two candidates are scheduled to appear at a charity dinner on Thursday night in New York.
Polls suggest Mrs Clinton is ahead nationally and in key battleground states.
What happens next?

The bitter rivals will sit one seat apart, with New York's Cardinal Timothy Dolan in the middle.
- The two candidates will spend the remaining 18 days before the election criss-crossing the US in their bid to persuade undecided voters. Expect to see lots of appearances in battleground states such as Ohio, North Carolina, Florida and Pennsylvania.

Ian Drake: British Cycling chief executive to leave his position in April
Drake, CEO since 2009, has been in charge during a hugely successful era.
His exit, revealed by BBC sports editor Dan Roan, comes as British Cycling is under scrutiny from UK Anti-Doping (Ukad), which is investigating allegations of wrongdoing in the sport.
The claims surround therapeutic use exemptions (TUEs), and the administering of medication to riders.
Ukad officials visited British Cycling headquarters earlier this month, saying the meeting was arranged with the governing body's "full co-operation".
A day earlier, former Team Sky rider Jonathan Tiernan-Locke had told BBC Sport he was "freely offered" the controversial painkiller Tramadol when competing at the Road World Championships four years ago.
British Cycling put the allegation to the medic in question, doctor Richard Freeman, on the BBC's behalf. He denied it.
Team Sky are also under investigation, and their former rider Sir Bradley Wiggins, a Tour de France winner, has been criticised over his use of TUEs.
There is no suggestion British Cycling, Team Sky or Wiggins have broken any rules.
Wiggins took anti-inflammatory drug triamcinolone for allergies and respiratory problems shortly before the 2011 and 2012 Tours and the 2013 Giro d'Italia, his TUEs having been approved by the relevant authorities.
In an interview with BBC Sport published earlier on Thursday, former head of British Cycling Peter Keen said he feared the controversy could cause "collateral damage" to Team GB.
He said it would be an "absolute tragedy" if innocent riders were unfairly tainted, adding there were "lessons to be learned" for British Cycling and Team Sky.
British Cycling's independent review is yet to publish its findings into the allegations surrounding Australian Sutton, 59.
In April, the organisation was also ordered by UK Sport to investigate allegations official kit - including a high-performance bike - had been sold online for profit.
Britain's golden period under Drake

If you think about what has happened under his watch, an awful lot has changed for the sport, not least the performance at the very top of the sport.
The track cyclists in particular have been the driving force for Britain becoming an Olympic powerhouse - cycling has become the most successful Olympic sport in this country.
Paul Pogba scored twice as Manchester United coasted to a comfortable victory over Fenerbahce and moved second in Europa League Group A.

With Wayne Rooney back in the team, United did not create much before the Turkish side gave away two cheap penalties.
World record signing Pogba smashed in after Simon Kjaer fouled Juan Mata before Anthony Martial converted following Sener Ozbayrakli's push.
Pogba guided a superb curling shot home from 20 yards with Jesse Lingard drilling home from similar distance to put the game out of sight after the break.
The second half was played out in an exhibition atmosphere and Robin van Persie's late consolation was applauded heartily as he met a low cross to mark his return to his former side with a goal.

Harder tests than a flimsy Fenerbahce side will come - not least the visit to Chelsea in the league on Sunday - but Pogba looks increasingly ready to meet and pass them.
"Two days ago he was the worst player in the Premier League and 48 hours later he's phenomenal," said manager Jose Mourinho, referring to criticism aimed at Pogba after his performance in Monday's goalless draw with Liverpool.

South Africa 'to withdraw from war crimes court'
Last year, South Africa refused to arrest Sudanese President Omar al-Bashir, who is wanted by the ICC on charges of genocide and war crimes.
He was attending an African Union summit in Johannesburg.
Mr Bashir denies allegations he committed atrocities in Sudan's troubled western Darfur region.
What is the International Criminal Court?
Several media outlets say they have obtained a copy of the "Instrument of Withdrawal", signed by South Africa's foreign minister.
"The Republic of South Africa has found that its obligations with respect to the peaceful resolution of conflicts at times are incompatible with the interpretation given by the International Criminal Court," the document says.
Neither South Africa nor the UN have officially confirmed the media reports.
There are also conflicting legal opinions as to whether South Africa can leave the ICC without parliamentary approval.
'Runaway train'
Human Rights Watch criticised the reported move."South Africa's proposed withdrawal from the International Criminal Court shows startling disregard for justice from a country long seen as a global leader on accountability for victims of the gravest crimes," said Dewa Mavhinga, the NGO's Africa division senior researcher.
"It's important both for South Africa and the region that this runaway train be slowed down and South Africa's hard-won legacy of standing with victims of mass atrocities be restored," Mr Mavhinga said.

Last year, South African warned it might leave the ICC.
The reported move to leave comes a week after the South African President Jacob Zuma visited Kenya, a country that has been highly critical of the ICC ever since the prosecutor charged its President Uhuru Kenyatta with crimes against humanity.
He denied the charges, and the trial later collapsed due to lack of evidence.
Two weeks ago Burundi became the first country to express its intent to pull out of the ICC - a decision described by the court as "a setback in the fight against impunity".
Previously, the African Union has urged member states not to co-operate with the ICC, accusing it of bias against Africa.
The 124-member ICC opened in 2002. It is the first legal body with permanent international jurisdiction to prosecute genocide, crimes against humanity and war crimes.
